Terms & Conditions

1- Object

This contract, concluded between the garden of the parish and the customer, concerns the lease, according to the type for tourist purposes, of the apartment indicated in the booking, with the prohibition of sub-letting and transfer of the contract.
Any additional services can be booked on site, directly upon arrival at the GdP.

2- Reservations

The booking request must be drawn up on a specific contractual form, also in electronic format, completed in its entirety and signed by the customer who will receive a copy.
When completing the booking, the customer must indicate all the names of the people who will stay in the rented apartment. In case of omission, access to the facility may be refused to persons not indicated on the booking form.
By signing this booking form, the Customer declares to have read the GdP website and, therefore, the characteristics of the apartment, the related services as well as these general conditions which he expressly declares to accept.

3- Booking acceptance and contract conclusion

The acceptance of the reservation by the GdP is subject to the prior verification of the availability of the structure and the contract will be considered finalized only when the GdP will send the customer, also by electronic system, the relative confirmation.

It will be the responsibility of the GdP, upon receipt of the balance of the rental price, to send the Customer a voucher with the services booked and the directions necessary to reach the accommodation booked. The voucher will show the name of the subjects indicated in the booking and will be valid only for these subjects. The Voucher must be delivered upon arrival by the Customer directly to the reception staff. Any other replacement document will not be considered valid unless issued by the GdP.

4 – Payments

At the time of booking, a sum equal to 30% of the total price must be paid directly to the GdP; the balance of the price of what has been booked must be received by the GdP at least 40 days before the expected date of arrival. For bookings made within 30 days prior to the arrival date, the balance must be paid at the time of booking. Payments must be made in the currency indicated in the GdP catalogs, by bank or postal transfer, or by credit card. The Customer must send Jolie Toscane a fax proving the transaction with the indication of the reservation and the name of the booked apartment. In case of failure to send the confirmation of the transaction, access to the facility may be denied.
The price of the apartment, as indicated on the website and confirmed at the time of booking confirmation, will include daily accommodation, breakfast, heating and / or use of the room air conditioning system.
This amount must be paid directly to the owner of the structure and / or his representative on site at the time of delivery of the structure according to the rates indicated on the GdP website, which the contractor declares to know and accept.

However, they are excluded and, therefore, must be paid separately:
– The cost of the cleaning service;
– The cost of excursions.
The security deposit will be returned, after checking the condition of the apartment, bathroom and related furnishings, to be carried out by the staff of the GdP, at the time of release.

5 – Resolution of law and penalty clause

In case of failure to pay the balance within the terms indicated in art. 4 of these general conditions, the sum paid at the time of booking will be retained by the GdP, pursuant to and for the purposes of art. 1382 cod. civ. Italian, except for compensation for further damage, and the contract will be considered terminated by law.

6 – Arrivals and departures

The customer must arrive at the GdP facility between 3.00 pm and 7.00 pm on the scheduled day. The structure must be vacated between 8.00 and 10.00 on the day of departure. In case of delay in the release, the Customer will be charged for the additional stay, at the cost indicated on the website of the GdP. To this end, the customer hereby authorizes Jolie Toscane and / or her representative to withhold the relative sums from the security deposit and in any case without prejudice to the greater damage caused by non-release.

7 – Waivers

The customer who intends to renounce the reservation will be entitled to a refund of the price paid net of the penalties, indicated below, in addition to the greater damage:
• 30% of the rental price for cancellations communicated within the 60th and 30th day prior to arrival;
• 70% of the rental price for cancellations communicated between the 28th and 15th day prior to arrival;
• 90% of the rental price for cancellations communicated between the 14th and 8th day prior to arrival.
No refund will be due in case of cancellations communicated starting from the 7th day prior to the arrival date.

8- Disputes and complaints

During the lease period, the Customer, under penalty of forfeiture, will have to contest in writing to the GdP staff, in charge of assistance, immediately and, in any case, without delay, any defect and / or discrepancy of the structure, so that it can take action in order to remedy.

9 – Insurance

It is advisable for customers to take out insurance policies at the time of booking against expenses arising from any waivers as well as stipulate an assistance contract that covers the return costs in the event of accidents and / or illnesses.

10– Obligations of the Customer

The Customer is obliged to obtain a passport, if this is required, or another valid document for the use of the services booked. He is also obliged to strictly comply with all the provisions issued by the competent Authorities, or to abide by the regulations in use within the booked structure and in any case to conform his behavior to the rules of prudence, diligence and good conduct.

11- Privacy

The GdP informs that all personal data of which it will become aware in the performance of its duties will be treated in full compliance with the provisions of the Legs decree. 196/2003 and such data will be processed solely and exclusively to perform the services covered by the reservation with the customer’s right to request cancellation at any time by sending a specific e-mail to the following address info@lacerbaiola.com, or by letter to be sent at the headquarters of the Company.

12 – Jurisdiction

For any dispute arising from the interpretation and / or execution of the contractual relationship between the GdP and the Customer, the Court of Pisa will have exclusive jurisdiction.
